​1. Applicability

These General Terms & Conditions apply to all services, proposals, projects and agreements carried out by Homeness Design.

2. Quotations

All quotations are valid for 14 days unless otherwise agreed in writing.

Obvious typing, calculation or informational errors may be corrected by Homeness Design.

The start of work after verbal, written or digital approval shall be considered acceptance of these General Terms & Conditions.

3. Digital Communication

Messages, approvals and confirmations made digitally have contractual validity.

Approvals given via e-mail, WhatsApp, Instagram or digital platforms are considered valid and official.

4. Creative Services

Homeness Design operates exclusively as an interior design, styling and creative consultancy studio.

Homeness Design does not act as a construction company, registered architect, engineer, contractor, executor of works or technical supervisor.

The company maintains creative freedom within the approved client briefing.

References from Pinterest, Instagram or other platforms serve solely as aesthetic inspiration.

Homeness Design aims to create spaces that reflect aesthetics, functionality and well-being, while respecting the client's lifestyle and personality.

5. Execution of Services

Homeness Design shall perform its services with reasonable care, professionalism and diligence, in accordance with the standards applicable to the Dutch market and professional practice.

6. Client Cooperation

The Client agrees to provide all information, measurements, references, approvals and materials required for the proper execution of the services.

7. Revisions

The number of included revisions shall be defined in the proposal or agreement unless otherwise agreed in writing.

Additional revisions, significant alterations or changes to the briefing may be charged separately.

Substantial changes after approval may be considered a new project or a new contractual phase.

8. Purchases, Products and Sourcing

Homeness Design acts solely as an aesthetic and consultative intermediary.

Responsibility for delivery, quality, installation, warranty, timelines and contractual compliance remains with suppliers and service providers.

Homeness Design may assist with sourcing, recommending or purchasing products and materials.

Homeness Design does not guarantee stock availability, product availability, continuity of collections or exact colour and material consistency.

Homeness Design shall not be liable for supplier delays, transport damages, manufacturing defects, price changes or third-party failures.

Moodboards, renderings and digital images may differ from the final result.

Differences in colour tone, texture, finish, lighting and visual perception may occur.

Products purchased on behalf of the Client cannot be returned through Homeness Design unless this is permitted by the supplier.

9. Construction and Execution

Responsibility for the physical execution of works remains with the professionals hired for that purpose.

Homeness Design may visually follow up the project without assuming technical, structural, electrical, plumbing or construction responsibility.

Homeness Design does not technically supervise construction works.

The company shall not be liable for delays caused by suppliers, contractors, transport companies or execution of works.

The Client remains responsible for the final verification of measurements, technical compatibility, installations and safety.

10. Timelines

If the Client does not provide feedback or approvals within 7 business days, the timeline may automatically be extended.

Provided timelines are estimates and may be subject to changes due to revisions, supplier delays, changes requested by the Client or force majeure situations.

11. Payments

Invoices must be paid within the stated payment term.

In case of late payment, Homeness Design may suspend services, postpone deliveries and charge statutory interest and administrative costs.

Advance payments made for agenda reservation or project initiation are non-refundable unless otherwise agreed in writing.

12. Cancellations

Both parties may terminate the project in writing.

In case of cancellation by the Client, services already performed remain payable.

Reserved hours and costs already incurred may be charged.

Homeness Design may terminate projects in case of lack of communication, inappropriate behaviour or excessive payment delay.

13. Copyright and Intellectual Property

All creative materials remain the intellectual property of Homeness Design.

Projects may not be copied, reused, reproduced or commercialised without written permission.

Concepts, moodboards, layouts, renderings and creative materials are protected by copyright.

The Client may not resell or reuse the projects without written authorisation.

14. Portfolio and Social Media

Homeness Design may use project images for portfolio, website, Instagram, Pinterest and marketing purposes unless otherwise agreed in writing.

If the Client does not wish the project to be disclosed, this must be communicated in writing before the start of the services.

15. Privacy and AVG/GDPR

The Client's personal data shall be processed in accordance with European data protection legislation (AVG/GDPR).

Information shall be used exclusively for communication, project execution, invoicing and administrative organisation.

Homeness Design does not sell personal data to third parties.

16. Force Majeure

Homeness Design shall not be liable for delays caused by illness, supply issues, strikes, pandemics, transport failures, governmental measures or situations beyond its reasonable control.

17. Professional Insurance

Homeness Design may maintain professional liability insurance (beroepsaansprakelijkheid) as applicable to its activities.

Any liability of Homeness Design shall be limited to the amount effectively covered and paid by the respective insurer, plus, where applicable, the deductible/eigen risico amount.

If the insurer does not fully cover the event, Homeness Design's liability shall remain limited as provided in these General Terms & Conditions.

18. Liability

Homeness Design has an obligation of effort and does not guarantee a specific result.

Homeness Design may only be held liable for direct damages resulting from proven gross professional negligence.

The liability of Homeness Design is limited to the amount effectively paid by the Client for the project or to the amount effectively covered by the professional insurer, where applicable.

Homeness Design shall not be liable for:

• indirect damages;

• consequential losses;

• loss of profits;

• third-party claims;

• third-party failures;

• execution delays;

• structural issues;

• financial losses.

19. Applicable Law

These General Terms & Conditions are governed exclusively by Dutch law.

20. Competent Court

Any disputes shall be submitted to the competent court in the Netherlands.
